Our goal has been to make these terms accessible for everyone while staying compliant.
1. Scope and Purpose
- These general terms and conditions ("Terms and Conditions") shall apply to all contracts entered into between us Backstory ("Backstory", "we", "our" or "us") and you as our customer ("Customer" or "you"). You are only allowed to use Backstory's services if you accept the Terms and Conditions.
- The version of the Terms and Conditions that apply to your contract shall be the ones in force at the time of the conclusion of the contract.
- We do not accept differing terms and conditions of the Customer, even when the Customer draws our attention to said differing terms and conditions and we do not expressly reject the inclusion of these terms and conditions.
2. Our Services and Your Use of Our Services
- Backstory's business is the provision of an online calendar and email integration application through its webpage app.withbackstory.com (the "Backstory App" and together with the Webpages the "Services"). Backstory does not guarantee that the Services meet your specific requirements or expectations.
- Customers require a personal user account ("Personal Account") to use the Services. They must register with their email provider of choice and provide access to the calendar and email associated with the used email address. Customers are responsible for ensuring that their data is up-to-date and correct and for all content posted on their Personal Account as well as for any activities occurring under their Personal Account.
- Customers must prevent unauthorized access to their Personal Account. Backstory is not liable for any loss or damages from your failure to comply with this section.
- Customers agree to inform Backstory without delay if they find out that unauthorized use has been made to their Personal Account.
- The Paid Services (defined below) can only be accessed and used by Customers who are at least eighteen (18) years old. If you are not at least eighteen (18) years old, you are prohibited from accessing and using the Paid Services.
- Customers must not:
- (i) use or attempt to use someone else's Personal Account and/or access someone else's data,
- (ii) set up a Personal Account using a false identity or the identity of another person,
- (iii) access the Services in any manner other than through the methods provided by Backstory,
- (iv) use the Services in any way that violates any applicable laws or regulations,
- (v) transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation,
- (vi) use the Services in a way that infringes upon the rights of others or restricts or inhibits anyone's use or enjoyment of Services, or
- (vii) attempt to interfere with the proper working of Services.
3. Pricing
- The use of the Services may be subject to a (recurring) payment ("Paid Services"). The Paid Services and the respective prices ("Price") are shown on the Webpages or in the Backstory App.
- The Price includes any applicable sales taxes. Any other duties or taxes will be for the Customer's account.
4. Payment
- If the Price for the Paid Services has not been paid in full, Backstory may temporarily freeze the Personal Account or suspend access to features until payment is made.
- Payments can be made by credit card. Backstory reserves the right to add or remove payment options at any time.
- Invoices will be sent to the email address specified by the Customer in the Personal Account.
5. Promotions
- Any contests, sweepstakes, or other promotions ("Promotions") may be governed by separate rules. Please review the applicable rules and our Privacy Policy. If Promotion rules conflict with these Terms and Conditions, the Promotion rules will apply.
6. Renewal and Cancellation of Paid Services
- Paid Services subject to recurring payments will automatically renew. If payment cannot be processed, section 4.1 applies.
- You can cancel the Paid Services and downgrade to a free plan by selecting the option on the Webpages or inside the Backstory App or by emailing support@withbackstory.com.
- If you cancel, you retain access to paid features until the end of your current term.
7. Termination and Temporary Blocking
- You can terminate your Personal Account at any time through the Webpages, Backstory App, or by emailing support@withbackstory.com.
- Access to Services and content will be inaccessible immediately upon termination. Content will be permanently deleted after 30 days.
- Backstory can terminate your account with two (2) weeks' notice.
- Statutory termination rights remain unaffected.
- Backstory may temporarily or permanently block accounts in case of breach. No payment for Paid Services is required during the blocking.
8. Copyrights
- The Backstory App is copyrighted.
- Backstory grants you a non-exclusive, non-sublicensable, and non-transferable right to access and use the Services.
- Further use, reproduction, or distribution of materials without explicit written consent is prohibited.
9. Limitation of Liability
- Backstory is not liable for any direct, indirect, incidental, consequential, or exemplary damages resulting from your use of the Services.
- Backstory is not responsible for third-party content, websites, or services linked to or from our Services.
- Mandatory US legal liabilities remain unaffected.
10. Data Protection
- Backstory processes data according to applicable US data privacy laws. See our Privacy Policy on the Webpages or in the Backstory App.
11. Consumer Rights, Error Reporting, and Feedback
- For defect claims, contact support@withbackstory.com.
- You may submit feedback via the Webpages, Backstory App, or support@withbackstory.com. Submitted feedback becomes property of Backstory and is not considered confidential.
12. Final Provisions
- If any provision is invalid or voided, it does not affect the remaining provisions.
- These Terms and Conditions are governed by the laws of the United States.
- The exclusive place of jurisdiction is San Francisco, CA.
- Backstory reserves the right to amend these Terms and Conditions.
- Updates to the Terms and Conditions will be announced at least four (4) weeks in advance. Continued use of the Services after changes implies acceptance.
